The majority of criminal and traffic charges brought by law enforcement officers will start in the General District Courts of Fairfax County, Loudoun County, or Prince William County. The General District Courts handle traffic violations, Reckless Driving and DUI charges, misdemeanors like assault, petit larceny, trespassing and Drunk in Public. Virginia General District Courts also hold felony arraignments and preliminary hearings for felony charges. If a case goes to trial in Virginia General District Court, it is decided by a judge, not a jury. If the decision is not in a defendant’s favor, they have a automatic right to appeal the case to the jurisdiction’s Circuit court within 10 calendar days.
