However, Oregon and Louisiana still allowed such convictions without unanimous consent.<\/h4>\n\n\n\n<figure class=\"wp-block-image size-full\"><img data-recalc-dims=\"1\" decoding=\"async\" width=\"370\" height=\"250\" loading=\"lazy\" src=\"https:\/\/i0.wp.com\/kazibari.com\/website_7dc4621b\/wp-content\/uploads\/2025\/05\/flag.jpeg?resize=370%2C250&#038;ssl=1\" alt=\"\" class=\"wp-image-305\" srcset=\"https:\/\/i0.wp.com\/kazibari.com\/website_7dc4621b\/wp-content\/uploads\/2025\/05\/flag.jpeg?w=370&amp;ssl=1 370w, https:\/\/i0.wp.com\/kazibari.com\/website_7dc4621b\/wp-content\/uploads\/2025\/05\/flag.jpeg?resize=300%2C203&amp;ssl=1 300w\" sizes=\"auto, (max-width: 370px) 100vw, 370px\" \/><\/figure>\n\n\n\n<p class=\"\">The case was brought to the Supreme Court by Evangelisto Ramos, who was convicted of murder in a Louisiana court by a 10-2 jury verdict in 2016. The Supreme Court\u2019s new ruling could allow Ramos to receive a new jury trial for the murder charge.<\/p>\n\n\n\n<p class=\"\"><strong>The decision of the case was unusual in that the typical conservative\/liberal sides of the court were realigned<\/strong>.\u00a0 The 6-3 ruling in the case, Ramos v Louisiana, had conservative Justices Neil Gorsuch, Clarence Thomas, and Brett Kavanaugh join with Ruth Bader Ginsburg, Stephen Breyer, and Sonia Sotomayor for the majority opinion.<\/p>\n\n\n\n<p class=\"\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" height=\"233\" width=\"296\" src=\"https:\/\/i0.wp.com\/d11upr8lrcn9x7.cloudfront.net\/www.novaattorneys.com\/s3fs-public\/inline-images\/justices%20of%20the%20SC.jpg?resize=296%2C233&#038;ssl=1\" alt=\"\"><\/p>\n\n\n\n<p class=\"\">Justices Samuel Alito, Elena Kagan, and John Roberts were the three justices that dissented.<\/p>\n\n\n\n<p class=\"\">Supreme Court Justice Neil Gorsuch wrote the opinion for the majority. \u201cWherever we might look to determine what the term \u2018trial by an impartial jury trial\u2019 meant at the time of the Sixth Amendment\u2019s adoption\u2014whether it\u2019s the common law, state practices in the founding era, or opinions and treatises written soon afterward\u2014the answer is unmistakable\u201d&nbsp; Gorsuch concluded \u201c<strong>A jury must reach a unanimous verdict in order to convict.<\/strong>\u201d<\/p>\n\n\n\n<p class=\"\">Previously, unanimous verdicts had been required for convictions for all federal jury criminal trials.<\/p>\n\n\n\n<p class=\"\">Most states, including Virginia, have banned non-unanimous jury verdicts for conviction in criminal cases. The new Supreme Court ruling applies a unanimous-conviction requirement in the Sixth Amendment of the Constitution to state law.<\/p>\n\n\n\n<p class=\"\">Currently, Oregon is the only state which allows conviction of criminal defendants even if up to two jurors dissent. &nbsp;Louisiana outlawed non-unanimous jury verdicts for conviction in 2019.<\/p>\n\n\n\n<p class=\"\">This will allow Mr. Ramos to request a new trial.&nbsp;
