Will you be required to have an ignition interlock device on your car after a DUI conviction in Fairfax?<\/strong><\/h3>\n\n\n\n

In short, if you are convicted of a DUI in Fairfax, interlock must be ordered by the Court as a condition of a restricted license<\/strong>.<\/p>\n\n\n\n

There is only one exception, that is for DUI offenses based on drugs. However, even for a DUI drug charge, the Court has the option to order that interlock be installed as well.<\/p>\n\n\n\n

On a first-offense DUI in Fairfax<\/strong>, the judge can order that the interlock be installed on a vehicle as a condition of a restricted license. You will not be able to drive any car that does not have the interlock device installed.<\/p>\n\n\n\n

After six months, you can request that the judge remove the interlock device. However, if the interlock is removed, it may also affect the terms of your restricted license.<\/p>\n\n\n\n

For a second-offense DUI in Fairfax<\/strong>, the judge will order that the interlock device be installed on all vehicles you own. This may require that the interlock device be installed on a spouse\u2019s car, or a car that is used by a child. We frequently advise our clients to re-title the vehicles they have solely in a spouse\u2019s name to avoid the interlock requirement on every vehicle in a household.<\/p>\n\n\n\n

How do ignition interlock devices work after installation as part of the punishment for a Fairfax DUI conviction?<\/h3>\n\n\n\n

If the Fairfax County General District Court requires a driver to install and use an ignition interlock device, the driver often has questions like \u201cHow does an interlock device work?\u201d.  After a Fairfax DUI ingition interlock order, the driver can also be worried about how it will affect their day-to-day driving routine and where to get an interlock device installed in Fairfax County.<\/p>\n\n\n\n

An ignition interlock device is a breathalyzer installed in a truck or car that measures the level of alcohol in a person’s breath before allowing the vehicle to start.<\/p>\n\n\n\n

The interlock device is connected directly to the car or truck\u2019s ignition system.  A driver is required to blow into the attached mouthpiece to test their breath alcohol content or BAC.  If the alcohol content in the breath exceeds a certain level, the ignition interlock device temporarily prevents the vehicle from starting or continuing to run.<\/p>\n\n\n\n

The data from the device is sent to the Fairfax County ASAP program.  If there are problems with a driver’s breath alcohol content or the driver fails to follow instructions how to use the interlock device, the ASAP program may report the driver to a Fairfax County court judge.  The judge will determine whether to issue a Rule to Show Cause, and to set hearing for a Probation Violation for the Fairfax DUI case.<\/p>\n\n\n\n

The interlock device installation will take place at a state-approved service center in Fairfax County.  The service center should take care of the installation process and provide the driver with instructions on how to properly use the ignition interlock device.<\/p>\n\n\n\n
